Every update removes a few fx from the folder I put them in and puts them into root.

For the internal effects, their location is stored in internalPluginLocations in settings.xml
This shouldn't change because of an update though, but you could try to backup settings.xml and compare the value of this before and after the update.
For other effects, they are actually moved to sub-folders, but I don't see why these would automatically move after an update either.

Figured it, It's not update that does it, it's between working with x86 & x64.
Some of the folders have different names, 86=filter 64=filters.
Chalk this one down to idiot factor.
